CASAPPAL DIGMI BED.

After several hearing lasting several wooks Judge

Liu of the Frovincial nigh Court, on the 24th instant

delivered judgment on the Arms Coal Case appeal

submitted by Messrs. Siemsson & Co. (respondents,

Kwangtung Aviation Bureau). The appeal was dismi:sed

with costa ordered paid by appellante.

The case concerned the fail re of the appellant

to deliver a chigo of aeroplanes and aaminition ordered

and fully paid for by the aviation Bureau. The

original judgment, which is now upheld, required the

defenuants, now appellant, to return to the aviation

Bureau the purchaLe price paid plus interest.

ir. . P. Chion, counsel for the Aviation Bureau,

persistently stre:bed the point that according to

Chinese lax, the handing over of the 3111 of Lading

does not constitute a discharge of the antire

obligation of the vendor of the burgo, as claimad

by the appellant firm.
